Terms of Use
differential.tools is currently in free alpha and beta. These short terms set out what you can expect from the service today, and what we expect from you in return. Once we move out of beta and introduce paid tiers, we will publish a full set of Terms and Conditions and notify users in advance.
01Who we are
differential.tools is operated by Differential Australasia Pty Ltd (ABN 73 680 913 213), based in Melbourne, Australia. Differential operates studios in multiple jurisdictions, and the long-term operating entity for differential.tools is being finalised; until we say otherwise, the Melbourne entity is the operator for the purposes of these terms. 02The service is provided “as is”
differential.tools is early-stage software offered free of charge during alpha and beta. It is provided “as is” and “as available”, without warranties of any kind. Features may change, break or be withdrawn, and the service may be unavailable from time to time. We don’t promise uptime, performance, or that the service will be free of bugs or errors during this period.
03How your geometry is processed
Today, parsing and rendering of all geometry happens on your own device — your computer, tablet or phone. For models you simply open and view, your geometry is not uploaded to our servers. Where you actively choose to save, share or embed a model, the relevant content is uploaded to our infrastructure so we can provide that feature for you.
04Your content stays yours
You retain all rights in any model, geometry, texture, metadata or other content you upload, save, share or embed. We do not claim ownership of your content, and we will not use your content to train any AI or machine-learning model. Where content is uploaded to our infrastructure (for save, share, embed or any future server-side processing), we use it only to the extent needed to operate the service for you — to display, render, share or embed it as you have asked us to.
05Don’t rely on it for safety-critical decisions
Measurements, dimensions, snapping, view angles and any other values shown by the viewer are provided for reference only. Do not rely on them for structural, regulatory, compliance, fabrication or any other safety-critical decision without independent verification by a qualified professional. This applies whether geometry is processed on your device or, in future, on our servers.
06Acceptable use
While using differential.tools, you agree not to:
- upload content you don’t have the right to upload, or that infringes anyone else’s intellectual property, confidentiality or privacy;
- upload anything unlawful, malicious, defamatory, harassing or designed to harm others;
- attempt to attack, reverse-engineer, or probe the security of the service, except under a written agreement with us;
- scrape, crawl or extract data from the service in bulk;
- misuse the service in a way that imposes an unreasonable load on our infrastructure or degrades the experience for other users; or
- use the service in any application where its failure could cause death, personal injury or serious damage.
We may suspend or remove access for anyone we reasonably believe is breaching these rules.
07Sharing and embeds
If you create a share link, embed token or live stream, anyone with that link can view the relevant content. You are responsible for treating share tokens as sensitive and for revoking them when no longer needed. Embeds may carry differential.tools branding during alpha and beta.
08Privacy
We collect the minimum data needed to run the service — typically an email address (if you create an account), basic usage analytics, and any files you actively choose to save, share or embed. We don’t sell your data, and we don’t use your content to train AI models (see section 04). When we introduce paid tiers, we’ll publish a fuller privacy policy alongside the full Terms and Conditions.
09Limitation of liability
To the maximum extent permitted by law, and given that the service is provided free of charge during alpha and beta, Differential is not liable for any indirect, incidental or consequential loss, or for any loss of data, profit, or business, arising from your use of (or inability to use) the service. Nothing in these terms excludes liability that cannot lawfully be excluded.
10Your rights under Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where we are permitted to limit our liability for a breach of a consumer guarantee, our liability is limited to re-supplying the service (or the cost of doing so).
11Changes and governing law
We may update these terms as the service evolves; if we make a material change we’ll take reasonable steps to flag it. These terms are governed by the laws of Victoria, Australia, and you agree to the non-exclusive jurisdiction of the courts of that state. Questions? Email hello@differential.studio.
differential.tools is in free alpha and beta. These terms will be replaced by a full set of Terms and Conditions when paid tiers launch.
